This report is presented pursuant to the mandate contained in the “Agreement between the General Secretariat of the Organization of American States (GS/OAS), the Inter-American Commission on Human Rights (IACHR) and the Nicaraguan government for the investigation of the violent events that took place in Nicaragua between April 18th and May 30th, 2018 (hereinafter “the Agreement”). The GIEI stresses the importance of the decision of all signatories of the Agreement of May 30th, 2018 to establish an international mechanism in order to support the clarification of those violent events.

EVENTS

This multimedia platform, created through the joint work of the Interdisciplinary Group of Independent Experts (GIEI) for Nicaragua, SITU Research, and the Argentine Forensic Anthropology Team (EAAF), presents documentation and analysis of 4  GIEI- selected episodes of violence that took place in Nicaragua between April 18th and May 30th 2018. Functioning as both an archive and analytical tool, the platform mobilizes large volumes of user generated videos to improve our understanding of these complex events. 

Organized chronologically, a coordinated set of maps, diagrams, videos and text are presented to document clashes between protesters, police and para police groups. Utilizing many hours of footage and multiple perspectives, the work reconstructs key moment during the protests in time and space. In doing so, it aggregates what has been—until now— extremely disconnected pieces of evidence into a cohesive narrative and visual archive.
The goals of this work are threefold. First, to provide available evidence in a format accessible to the public. Second, to present a basic account and analysis of each selected episode. Third, to provide a clear and coherent summary within an otherwise overwhelmingly complex series of events.

GIEI

The independent experts were selected by the IACHR and appointed by the Secretary General of the OAS, with the appointment of Amerigo Incalcaterra, Sofía Macher, Pablo Parenti and Claudia Paz and Paz Bailey, all of them with a high technical level and a recognized career in the protection of human rights. human rights 7. The appointment, for a period of six months, extendable by agreement of the parties for the time necessary for the fulfillment of its objective 8, was reported to the Government of Nicaragua on June 29, 2018. The attributions of the GIEI agreed by the parties were the following:

  • A. Technically analyze the lines of investigation and make recommendations for actions regarding the different levels of legal responsibility, in accordance with Nicaraguan legislation.
    • a. Analyze if in the investigation all the lines of investigation are being exhausted correctly and if the appropriate legal figures are being used, in accordance with the Nicaraguan legislation, for the framing of the possible illicit and those responsible.
    • b. If this is the case and in accordance with the highest international standards and best regional practices, recommend what actions should be implemented to ensure that the lines of investigation are exhausted.
    • c. The GIEI will be empowered to contribute and support the investigations that the Nicaraguan authorities carry out.
    • d. The GIEI will be empowered to propose to the Nicaraguan authorities the adoption of additional measures that guarantee the security of the people who collaborate in the investigations that are carried out, whether as witnesses, experts or collaborators, in accordance with the Nicaraguan regulations in force.

 

  • B. Technical analysis of the Comprehensive Care Plan for Victims of the events that occurred during the period of April 18, 2018 to the date.
    • a. Analyze the intervention of the State to develop a Comprehensive Care Plan for victims and their families.
    • b. If this is the case and in accordance with the highest international standards and best regional practices, recommend what actions should be implemented to provide the necessary comprehensive attention and reparation to victims and their families.
    • c. The State reiterates its disposition that, based on the recommendations issued for this case by the Interdisciplinary Group of Independent Experts with reasons for the requested technical assistance, its institutional capacities should continue to be strengthened.

 

The GIEI began its work in Nicaragua on July 2, 2018, supported by an interdisciplinary technical team composed of professionals of various nationalities and specialties. On July 3, at a press conference, the GIEI was presented by the IACHR to Nicaraguan society.
